Law No. 185 of 2023, which amends several provisions of the Penal Code, introduces stricter measures to combat crimes of indecent exposure, sexual harassment, and bullying, particularly when such offenses are committed through any means, including wired, wireless, or electronic communication. The law places special emphasis on protecting children, prescribing harsher penalties when crimes target minors.
Under Article 306 bis (A), any individual who harasses another person in a public or private place, or in an area frequented by the public, through sexual or obscene acts, suggestions, or innuendos, whether by gesture, word, or deed, using any means, including wired, wireless, electronic communication, or other technological tools, shall face imprisonment for a period ranging from two to four years. The article also stipulates a fine of no less than EGP 100,000 and no more than EGP 200,000, or the imposition of either penalty.
Article 306 bis (B) provides for aggravated penalties in specific circumstances. The law prescribes imprisonment for at least one year and a fine ranging between EGP 20,000 and EGP 100,000, or either penalty, if the crime is committed in the workplace, on public transportation, by two or more perpetrators, or if the offender is a relative of the victim, a guardian, supervisor, or someone exercising authority over the victim, or entrusted with their care by law or judicial order. If two or more of these aggravating circumstances are combined, the law mandates doubling the minimum penalty, reinforcing the state’s commitment to deterring such crimes and ensuring stronger protection for victims.
